Senior Legal Officer, Regulatory Framework
Reports to : Assistant Manager, Legal Framework
Overall Job Purpose
Reporting to the Assistant Manager, Legal Framework, the Senior Legal Officer will be responsible for reviewing the capital markets enabling legislation, rules, regulations and guidelines in accordance with the strategic focus of the Authority, market needs and changing trends.
The Senior Legal Officer will also be charged with carrying out research of local, regional and international practices to guide recommendations on necessary amendments or new regulatory framework to facilitate efficient and orderly market operations and growth.
The Senior Legal Officer will be responsible for supporting and overseeing the research and legal drafting activities of Legal Officer, Legal Framework.
Core Duties and Responsibilities
Organise and coordinate the review of relevant aspects of cross-sectoral laws affecting capital markets and investment sector and recommend amendments to ensure fair, efficient and transparent capital markets to protect investors, reduce systemic risk, taking into account appropriate international standards;
Have regard to the need for the legal and regulatory framework to be based on rules that are founded on well-established practices and to the greatest extent possible to promote a drafting style that will ensure the framework can be widely understood, and is clearly expressed;
Prepare transparent, clear and concise guidelines and procedures to implement the regulatory framework;
Organise and coordinate the review of capital markets enabling legislation, rules, regulations and guidelines including conducting surveys and collecting data and information to support the amendment of capital market rules and regulations;
Facilitate industry consultations on proposed legislative amendments including coordinating stakeholder workshops and exposures sessions to collect feedback on areas in need of regulatory reform;
Engage with relevant internal and external stakeholders, including but not limited to the Attorney General’s Chambers, Registrar General, Law Reform Commission, any Securities Exchange, Central Securities Depository, capital markets intermediaries and other local and foreign regulators in financial markets to ensure the timely development and where necessary enactment of transparent and efficient laws, rules and regulations;
Develop guidelines, rules and procedures to implement the regulatory framework.
Review rules, procedures and other instruments proposed to be issued by Self-regulatory organizations, securities exchanges, central securities depositories and other market organizations with oversight responsibilities under either the Capital Markets Act or the Central Depositories Act.
Provide interpretation on application of legal and regulatory framework;
Any other duties as assigned from time to time
Minimum Qualifications
Bachelor’s degree in Law
Post-graduate Diploma in Law
Be an advocate of the High Court of Kenya of at least 3 years standing.
Certificate in Legislative Drafting
Minimum of three (3) years’ work experience in legal and regulatory framework development in the financial markets.

Skills Required
Knowledge of laws and regulations in the capital markets sector and in the financial sector
Experience in translation of policy into legislation
Ability to identify legal and regulatory impediments and provide practical solutions.

Legal Officer, Regulatory Framework
Reports to : Senior Legal Officer, Regulatory Framework
Overall Job Purpose:
Reporting to the Senior Legal Officer, Regulatory Framework, the Legal Officer shall be responsible for carrying out extensive legal research for benchmarking capital markets legal and regulatory framework with international best practice approaches.
Carrying out legislative drafting in line with benchmark standards to attain the strategic objectives and policies of the Authority.
Core Duties and Responsibilities
Carrying out legal research on benchmark standards on regulatory drafting in capital markets;
Drafting of capital markets legislative instruments;
Providing interpretation on application of legal and regulatory framework;
Participating in industry consultations on draft legislative instruments;
Engaging with internal and external stakeholders to ensure timely development of transparent and efficient laws, rules and regulations;
Any other duties as may be assigned from time to time
Minimum Qualifications
Bachelor’s degree in Law
Post-graduate Diploma in Law
Be an advocate of the High Court of Kenya with at least 2 years standing.
Evidence of training in legislative drafting
Minimum of two (2) years’ experience in legal and regulatory framework in the financial markets.
