After revelations of a community in the Bangladesh estate in Mombasa that is using Bangla Pesa as legal tender, lawyers say such a move is illegal. LSK Chief executive, Mr. Omboya, says that it is probable that the people using the currency are being taken advantage of, believing that theirs was barter trade.
He says that such an act 'contravenes the penal code, and one could face up to a lifetime in jail' for such crimes. It is even worse in that the burden of proof lies with the accused, unlike in normal cases where the burden of proof lies with the prosecution.
